Arkansas Mental Health Inpatient Licensing: Psychiatric Hospitals Under ADH
Inpatient psychiatric hospital care in Arkansas is licensed by the Arkansas Department of Health, and the rule that governs it is more specific than most operators expect going in.
Psychiatric hospitals: licensed by ADH under 20 CAR § 41-142
Standard psychiatric hospitals are licensed by the Arkansas Department of Health under 20 CAR § 41-142. Any facility used primarily for inpatient diagnostic care and treatment of people with mental disorders falls under this rule. It requires a board-certified psychiatrist as medical director coordinating psychiatric services alongside nursing, therapy, and hospital administration, a qualified director of nursing, 24/7 emergency service capability, and specific physical-environment safety requirements: no accessible sharps, controlled substances secured away from patients, and admission photographs unless the facility follows an alternative identification rule.
Inspections aren’t limited to scheduled surveys
Arkansas law lets ADH’s authorized representatives enter and inspect a licensed institution at any time to verify that it meets the minimum standards. That means the compliance file has to be ready on an ordinary Tuesday, not only in survey season. The medical director’s credentials, nursing leadership, emergency coverage, and the physical safety items above should all be provable on the spot.
Ketamine and Spravato in an Arkansas Psychiatric Hospital
Pieced together from ADH’s psychiatric hospital rule, the nursing board’s sedation position statement and the Spravato REMS. It’s an interpretation of how they fit, not guidance from ADH.
An ADH-licensed psychiatric hospital is the easiest place in Arkansas to add ketamine. 20 CAR § 41-142 already requires a board-certified psychiatrist as medical director and a qualified director of nursing, and it already requires controlled substances to be secured away from patients. Ketamine and Spravato come in through the hospital’s medical staff and pharmacy committee like any new protocol. The nursing piece is also cleaner here than in community settings, because the Arkansas State Board of Nursing’s Position Statement 94-1 was written around acute care settings with sedation monitoring protocols in place. Hospitals should still write the infusion policy so a physician or APRN sets each dose, since the position statement doesn’t name psychiatric ketamine.
For an Arkansas psychiatric hospital, the value of starting inside is the 24-hour nursing record that follows each session. A stay may last only a week, so the referral for continuing care is written when the series is ordered, and the patient isn’t left waiting on an outpatient slot after discharge.
Spravato slots into a hospital schedule with little friction. Registering under its REMS, keeping each patient under observation for two hours after a dose, and recording that on the REMS monitoring form is most of the added work. Because the Arkansas Department of Health can inspect a licensed institution at any time, the REMS forms and the ketamine count log should be ready to show on an ordinary day.
